Marina Agaltsova is Of Counsel at Nekrasov, Roudomanov & Partners and Co-Head of the Family and Succession Law Practice. Marina specialises in international family disputes, cross-border succession, protection of rights before international courts and tribunals, and complex public law litigation.
Marina has extensive experience handling landmark cases in Russian courts, including the Supreme Court of the Russian Federation, as well as representing clients before the European Court of Human Rights. She advises private clients and families with a Russian or international element: high-net-worth individuals, Russian nationals residing abroad, foreign nationals with interests and assets in Russia, and Russian-speaking clients outside Russia.
Marina is a qualified Advocate and a member of the Moscow City Bar Association.

Experience

Landmark cross-border family dispute: Represented a foreign parent in a landmark jurisdictional case on the competence of Russian courts to hear child proceedings; the Supreme Court of the Russian Federation set aside the refusal to accept the claim and confirmed jurisdiction. The case was included in the Supreme Court’s practice review .
Russian nationals residing abroad: Divorce, child maintenance, and child residence proceedings in a Russian court; maintenance awarded.
France-Russia international family: Handling a cross-border dispute between a French national and a Russian national, including parallel proceedings in France and Russia, jurisdictional issues, and recognition and enforcement of foreign judgments.
US and German nationals: Advising on inheritance of residential property in Moscow.
Russian nationals resident in Cyprus: Drafting a matrimonial property agreement covering foreign assets and funds held in foreign accounts, for notarisation at the Russian Consulate.
Mass public-law litigation: Represented 561 residents of Dagestan in proceedings for compensation for property lost following the flooding caused by the construction of the Irganai reservoir; the prolonged inaction of the Government of the Republic of Dagestan was declared unlawful and a legal basis for recovery of compensation was established.
Researcher / state archive user: Represented a researcher in proceedings against the Russian Ministry of Foreign Affairs concerning access to inventories of the Archive of the Foreign Policy of the Russian Federation; the case has implications for an indefinite class of state archive users.
Strategic archival dispute: Represented a descendant of a victim of political repression in proceedings before the Supreme Court of the Russian Federation concerning access to an archived criminal case file; access to the file was secured.
German researcher: Developed a novel legal strategy enabling a German researcher to obtain access to the archived criminal case file of his father.
L.A. and Others v. Russia (ECtHR): Landmark case on domestic violence and the State’s positive obligations to protect the right to life; the ECtHR found a violation of the Convention.
Yuriy Dmitriyev v. Russia (ECtHR): Represented historian Yuriy Dmitriyev before the ECtHR; violations of the right to liberty and security and the right to a fair trial were established.
Suprun and Others v. Russia (ECtHR): Conducted five cases in a group concerning access to archival information; the ECtHR found violations of the Convention and awarded compensation.
Kuriyeva v. Russia (ECtHR): Represented the applicant in a case concerning the killing of a person by law enforcement officers and the ineffective investigation thereof; the ECtHR found Russia liable.
Dispute with a French tyre supplier: Successfully argued that the defendant had raised its arbitration clause defence out of time, notwithstanding the presence of an arbitration clause; the cassation court upheld the client’s position and the claim was allowed.
ICAC construction arbitration: Represented a Turkish construction company in ICAC proceedings against a Japanese manufacturer; claims for recovery of the value of work performed but unpaid were allowed.
